Analisis de los convenios internacionales sobre el derecho de refugio suscritos y ratificados por el Ecuador

Resumen
De la Investigación realizada sobre los principales Instrumentos Internacionales en materia de Derecho de Refugio, se concluye que el Derecho Internacional Humanitario y el Derecho Internacional de los Derechos Humanos están intrínsecamente ligados al derecho de refugio, mismos que han sido reconocidos por los Estados de forma individual mediante tratados internacionales, que reconocen al derecho humanitario el carácter de norma imperativa o de derecho consuetudinario. El Derecho Internacional Humanitario debe ser aplicado en casos de violencia extrema, como el de los refugiados que huyen de sus países de origen por temor y debido a que sus vidas y libertad se encuentran en riesgo, de éste modo, el fundamento en la aplicación del principio de no devolución por parte de los Estados en el cumplimiento de sus obligaciones internacionales es incorporar a su legislación interna la prevalencia del derecho Humanitario, en los artículos relacionados con la movilidad humana previstos en los Artículo: 9, 40, 41, 416, 417, 424, 426 y demás pertinentes en materia del Derecho de Refugio y del Principio de “no devolución”, puesto que, el Estado ecuatoriano en el Art. 41, somete a la Norma Suprema, la Ley y los Instrumentos Internacionales de Derechos Humanos, inobservando, el principio de humanidad el cual constituye pilar fundamental del Derecho Humanitario y establece la necesaria coordinación y conexión con el Derecho Internacional de los Derechos Humanos, en el marco de la protección de la persona. Ante estas inconsistencias jurídicas, se propone una revisión profunda a los preceptos constitucionales en materia de movilidad humana.
From the research carried out on the main international instruments on refugee law, it is concluded that international humanitarian law and international human rights law are intrinsically linked to the right of refuge, which have been recognized by individual states Through international treaties, which recognize humanitarian law as a peremptory norm or customary law. International Humanitarian Law must be applied in cases of extreme violence, such as refugees fleeing their countries of origin for fear and because their lives and freedom are at risk, and thus the basis for the application of the law. Principle of non-refoulement by States in the fulfillment of their international obligations is to incorporate into their domestic legislation the prevalence of humanitarian law in articles related to human mobility, as provided for in Articles 9, 40, 41, 416, 417 , 424, 426 and other pertinent ones in the matter of the Right of Refuge and of the principle of "non-refoulement", since, the Ecuadorian State in Article 41, submits to the Supreme Norms, Law and International Instruments of Human Rights, Unobserved, the principle of humanity which constitutes the fundamental pillar of Humanitarian Law and establishes the necessary coordination and connection with the International Law of Law S Human, within the framework of the protection of the person. Given these legal inconsistencies, it is proposed a profound revision to the constitutional precepts in terms of human mobility
