Resumen
En los casos de vulneración de derechos, en los cuales no se han protegido derechos vulnerados al plantearse una Garantía Jurisdiccional como Acción de Protección, resarciendo a la víctima, por el hecho de haber juzgadores que no se encuentran actualizados con las nuevas doctrinas y teorías del Neo Constitucionalismo que plantea la Constitución vigente, por ende, no se cumple con el fin para que fue elaborada la Constitución. Es así que debemos de activar mecanismos que la Constitución nos otorga como derecho; exigir a la administración de justicia que cumpla con la realización de la justicia contemplada en el artículo ciento sesenta y nueve, garantizando la profesionalización mediante la formación continua de los servidores judiciales, como lo establece el artículo ciento setenta de la Constitución, formar continuamente a los jueces en materia de Derecho Constitucional y Derechos Humanos, con el fin de tutelar los derechos de los ciudadanos
In cases of violation of rights, in which rights violated have not been protected when considering a Jurisdictional Guarantee as a Protection Action, compensating the victim, for the fact of having judgments that are not updated with the new doctrines and theories of the Neo Constitutionalism that raises the current Constitution, therefore, is not fulfilled with the purpose for which the Constitution was drafted. This is how we must activate mechanisms that the Constitution grants us as a right; to demand that the administration of justice comply with the execution of justice contemplated in article one hundred and sixty-nine, guaranteeing professionalization through the continuous training of judicial servants, as established in article one hundred and seventy of the Constitution, continuously training judges in matters of Constitutional Law and Human Rights, in order to protect the rights of citizens.
