Resumen
El trabajo busca determinar la factibilidad de la aplicación del principio de favorabilidad dentro del proceso penal seguido por la Fiscalía en contra del Ing. Jorge Glas Espinel por el delito de asociación ilícita. Hemos tomado como objeto de análisis el auto de llamamiento a juicio emitido por el delito de Asociación Ilícita, que al momento de la comisión de los hechos (2010) estaba tipificado en el art. 369 del Código Penal y reprimido en el art. 370 ídem; y, al momento del juzgamiento (año 2017) se encuentra tipificado en el Art. 370 del COIP. Procedimos a analizar dogmáticamente el principio de favorabilidad y el tipo penal descrito en el Art. 370 del Código Penal, derogado; y, Art. 370 del COIP. Finalmente, hemos extraído conclusiones respecto a cuáles son las condiciones procesales que debe tomarse en cuenta para determinar cuándo es factible aplicar el principio de favorabilidad y cuando no.
The work seeks to determine the feasibility of applying the principle of favorability within the criminal process followed by the Prosecutor's Office against Mr. Jorge Glas Espinel for the crime of illicit association. We have taken as an object of analysis the order of appeal to trial issued for the crime of Illicit Association, which at the time of the commission of the events (2010) was classified in art. 369 of the Penal Code and repressed in art. 370 idem; and, at the time of trial (year 2017) is classified in Art. 370 of the COIP. We proceeded to analyze dogmatically the principle of favorability and the criminal type described in Art. 370 of the Penal Code, repealed; and, Art. 370 of the COIP. Finally, we have drawn conclusions about what are the procedural conditions that must be taken into account to determine when it is feasible to apply the principle of favorability and when not.
