Resumen
La aplicación de este derecho está a cargo de órganos que se encargan de administrar justicia, son ellos quienes deben activar la TUTELA JUDICIAL EFECTIVA, cuando un derecho está siendo vulnerado o cuando se puede prever que puede ser violentado. Es responsabilidad del Estado, que dentro de todo proceso se observe este principio; de lo contrario el Estado será responsable por su vulneración y deberá responder de forma obligatoria por su falta de aplicación, quien se vea afectado por tal o cual violación del derecho a la Tutela Judicial Efectiva está en la necesidad de ser indemnizado y de que el daño causado sea reparado.
The application of this right is in charge of bodies that are in charge of administering justice, they are the ones who must activate EFFECTIVE JUDICIAL PROTECTION, when a right is being violated or when it can be foreseen that it can be violated. It is the responsibility of the State, that within this process, this principle is observed; otherwise the State will be responsible for its violation and must respond in a mandatory manner for its lack of application, who is affected by this or that violation of the right to effective judicial protection is in need of compensation and that the damage caused be repaired.
