Análisis comparado del delito de violación a menores de 14 años en el Código Penal Peruano y el Código Orgánico Integral Penal Ecuatoriano.

Resumen
El trabajo investigativo, aborda un análisis del delito de violación a menores de 14 años, en el Código Orgánico Integral Penal y el Código Penal Peruano, resaltando diferencias existentes entre ambos países respecto a la aplicación de la pena, cuando el delito se cometiere a un menor comprendido entre 13 a 14 años, ambos cuerpos legales protegen la tutela jurídica, constituyendo un delito en todo sentido, pero en ciertos casos, dicho acto fue realizado sin violencia ni intimidación y con el consentimiento del menor de edad, nuestra investigación muestra los casos en los cuales nuestros legisladores deberían considerar la edad del victimario comprendido entre 18 y 21 años, como atenuante al aplicar la pena, y se éste actuó sin violencia ni intimidación, e incorporarlo en nuestro marco legal como un atenuante en el derecho a la defensa de la persona acusada por el delito de violación.
The investigative work addresses an analysis of the crime of rape of minors under 14 years of age, in the Comprehensive Criminal Organic Code and the Peruvian Penal Code, highlighting existing differences between both countries regarding the application of the penalty, when the crime is committed to a minor between 13 to 14 years, both legal bodies protect the legal guardianship, constituting a crime in every sense, but in certain cases, this act was carried out without violence or intimidation and with the consent of the minor, our investigation shows the cases in which our legislators should consider the age of the victimizer between 18 and 21 years, as mitigating the application of the penalty, and it acted without violence or intimidation, and incorporate it into our legal framework as an attenuating in the right to defense the person accused of the crime of rape.
