Vulneración de derechos dentro de un caso de restitución internacional de menores

Resumen
La Restitución Internacional de menores se produce cuando un menor es trasladado o retenido ilícitamente en un estado distinto al de su residencia habitual y para remediar esta situación, los Estados realizan grandes esfuerzos, tendientes a proteger internacionalmente a los menores de los efectos perjudiciales de su sustracción o retención ilícitas y a establecer procedimientos para su pronta restitución al Estado de su residencia habitual. En tal sentido, en el ámbito de la Conferencia de La Haya de Derecho Internacional Privado se ha elaborado en el año 1980 el “Convenio sobre los Aspectos civiles de la Sustracción internacional de Menores”. En el ámbito Interamericano, los Estados decidieron hacer hincapié en la solución del problema, más que en el conflicto mismo. Es por ello que al momento de redactar la Convención Interamericana sobre restitución internacional de menores, reemplazaron el término sustracción, utilizado por el Convenio de La Haya por el de “restitución”, que evidencia claramente la finalidad perseguida por el Convenio.
The International Restitution of minors occurs when a minor is transferred or illegally detained in a state other than their habitual residence and to remedy this situation, the States make great efforts, tending to protect internationally the minors from the harmful effects of their abduction or illegal retention and to establish procedures for their prompt restitution to the State of their habitual residence. In this regard, in the context of the Hague Conference on Private International Law, the "Convention on the Civil Aspects of International Abduction of Minors" was drafted in 1980. In the Inter-American sphere, the States decided to emphasize the solution of the problem, rather than the conflict itself. That is why at the time of drafting the Inter-American Convention on the International Return of Children, they replaced the term abduction, used by the Hague Convention for "restitution", which clearly demonstrates the purpose pursued by the Convention.
