La vulneracion del interès superior del niño por el incumplimiento del regimen de visitas por parte de los progenitores

Resumen
El estudio de investigación que se presentó tuvo como objetivo general determinar la vulneración del interés superior del niño por el incumplimiento del régimen de visitas por parte de los progenitores, tanto el que mantiene la custodia como el que no la posee. Por tal motivo, se realizó una etapa de recopilación de datos en cuanto a los tratados y convenios internacionales en materia de la niñez, específicamente un análisis de los aspectos más importantes de la Convención de los Derechos del Niño y la Declaración de los Derechos del Niño. Para posteriormente realizar una etapa en campo, en la cual se consultó un total de 60 padres o madres de familia que tengan proceso activo en cuanto a régimen de visitas. Se pudo conocer los aspectos del caso objeto de estudio, como ejemplo en relación a la obligación que se tiene para cumplir con la interacción del niño con ambos padres, pues la educación y crianza de los hijos no depende de un solo padre, sino de ambos, aunque no vivan juntos. Finalmente se diseñó una guía para padres como respuesta a la necesidad que tienen los padres de aprender sobre derechos del niño y sobre la obligación de la convivencia con padre y madre. Para finalmente llegar a las conclusiones, entre las que se destacan: El régimen de visitas en el Ecuador es una institución jurídica del derecho de familia, que se constituye debido a la necesidad de cumplir con el deber de mantener, las relaciones paterno filiales entre: los niños, niñas o adolescentes y sus padres. En tal sentido, se constituye en una de las figuras menos respetadas, pues generalmente, el padre custodio condiciona la visita de los hijos de acuerdo a su percepción personal. Con referencia al interés superior del niño, es bien sabido que no se ha invocado por mero formalismo, sino porque para el niño es necesario contar con la figura y presencia de ambos padres, en tal sentido, privar al niño de mantener relación con el padre no custodio genera ansiedades e irrumpe con su bienestar integral

For this reason, there was a stage of data collection regarding international treaties and conventions on children, specifically an analysis of the most important aspects of the Convention on the Rights of the Child and the Declaration of the Rights of the Child . To later carry out a stage in the field, in which a total of 60 fathers or mothers who had an active process regarding the visitation regime were consulted. It was possible to know the aspects of the case under study, as an example in relation to the obligation to comply with the child's interaction with both parents, because the education and parenting of children does not depend on a single parent, but on both , even if they don't live together. Finally, a guide for parents was designed in response to the need for parents to learn about children's rights and the obligation to live with their parents. To finally reach the conclusions, among which are: The visit regime in Ecuador is a legal institution of family law, which is constituted due to the need to comply with the duty to maintain, the paternal relations subsidiaries between: Children or adolescents and their parents. In this sense, it constitutes one of the least respected figures, since generally, the custodial father conditions the visit of the children according to their personal perception. With reference to the best interests of the child, it is well known that it has not been invoked by mere formalism, but because for the child it is necessary to have the figure and presence of both parents, in that sense, deprive the child of maintaining relationship with the father non-custodian generates anxieties and breaks into your integral well-being
