Vulneración del principio de gratuidad de la justicia por falta de recursos económicos en las etapas procesales penales en la Cuidad de Guayaquil en el 2018

Resumen
En el presente trabajo de titulación realizamos una investigación para determinar los casos en los cuales se vulnera el principio de gratuidad de acceso a la justicia en las etapas del proceso penal. Decidimos enfocarnos en la importancia de la valoración testimonial y el impacto que esta puede generar en la administración de justicia simplificando procedimientos judiciales y brindando una mayor confiablidad tanto en la victima como en la credibilidad del testimonio que realiza, y de esta forma se obvian los gastos procesales inherentes a cada caso de violación al esclarecer desde el inicio si se debe seguir una investigación o no. Desde la edad antigua en donde no se tenía la percepción clara de que se debía analizar el testimonio y los imputados eran sentenciados de forma inquisidora hasta la estructura ecuatoriana llena de principios y derechos que rodean al procesado y a la víctima que limitan el poder punitivo del estado y garantizan un camino hacia la justicia. La apreciación correcta del testimonio basada en principios filosóficos, psicológicos y jurídicos ha sido un camino lleno de pruebas y errores para desembocar en lo que conocemos tanto en legislación interna como en normativa extranjera, normativa que puede ser apreciada, comprendida y asimilada si comprendemos las razones para su aplicación y sus preceptos doctrinarios. La necesidad de una valoración pericial del testimonio en los casos de violación resulta imperativa en la legislación ecuatoriana, la creación e implementación de instrumentos multidisciplinarios de evaluación testimonial debe ser tratada como un derecho tanto para la víctima en casos de violación como para los imputados en los mismos procesos.
In this titling work, we carry out an investigation to determine which are the cases in which the principle of free access to justice is violated in the procedural stages of the criminal process and we decided to focus on the importance of testimonial assessment and the impact that This can generate in the administration of justice by simplifying judicial procedures and providing greater reliability both in the victim and in the credibility of the testimony that he / she carries out, and in this way the procedural expenses inherent in each case of rape are ignored since the beginning if an investigation must be followed or not. From the old age where there was no clear perception that the testimony should be analyzed and the accused were sentenced inquisitively to the Ecuadorian structure full of principles and rights that surround the accused and the victim that limit the punitive power of the state and guarantee a path to justice. The correct assessment of the testimony based on philosophical, psychological and legal principles has been a path full of evidence and errors to lead to what we know both in domestic legislation and in foreign regulations, regulations that can be appreciated, understood and assimilated if we understand the reasons for its application and its doctrinal precepts. The need for an expert assessment of the testimony in cases of rape is imperative in Ecuadorian legislation, the creation and implementation of multidisciplinary instruments of testimonial evaluation should be treated as a right for both the victim in cases of rape and those charged in the same processes.
