Analogía del procedimiento de extradición en el ordenamiento jurídico del estado unitario de Ecuador y el Estado Federal de la Confederación Suiza

Resumen
La Extradición es un método legal, que reconocen los estados ecuatorianos y suizos en su respectiva legislación; por ello, tienen una conexión con el derecho internacional, es decir, la extradición en el ámbito penal, debe respetar diferentes normativas para que se pueda ejecutar su aplicabilidad, en especial: Constitución, tratados y convenciones celebrados entre los Estados y leyes internas. Por consiguiente, es eficaz si los países forman parte de la Organización de las Naciones Unidas y así, poder cumplir con el objetivo de desarrollo sostenible, específicamente, el número dieciséis: Paz, justicia e Instituciones sólidas. Por tanto, el presente texto se fundamenta en los delitos o tipos penales que existen en Ecuador y Suiza, para evidenciar si la extradición se puede llevar a cabo; sin embargo, en los respectivas situaciones que no se puedan concretar, se patentizará, desde un punto de vista objetivo los vacíos o lagunas jurídicas que existen en el Código Orgánico Integral Penal de Ecuador y Código Penal Suizo (Codé Penal Suisse). Por ende, en general la investigación tiene elementos jurídicos que buscan mejorar la justicia internacional a partir del derecho comparado, teniendo en consideración el establecimiento de los delitos con sus respectivas privaciones de libertad o tratamientos institucionales.
Extradition is a legal method recognizer by both Ecuador and Switzerland in their own legislation. For this reason, extradition holds a connection with the international law, that is, extradition in the criminal sphere, must respect different regulations so that its applicability can be executed, especially: Constitution, treaties and conventions concluded between States and internal laws. Furthermore, it is even more important if the countries take part in the United Nations, so that they can better comply with the point regarding sustainable development number sixteen. More specifically: Peace, justice and solid Institutions. Therefore, the present text is based on the crimes or criminal types that exist in Ecuador and Switzerland, to show whether the extradition can be carried out. However, in the respective situations that cannot be specified, it will be evident, from an objective point of view, the gaps or loopholes that exist in the Organic Comprehensive Penal Code of Ecuador and the Swiss Penal Code (Codé Penal Suisse). Such work is characterized by the search of juridical elements aimed at the improvement of International Justice from the Comparative Law, holding under constant consideration the recognition of the criminal offences and their consequent sanction or institutional treatment of the matter.
