La inconstitucionalidad de los antecedentes personales, como requisito en la suspensión condicional de la pena, dentro del Código Orgánico Integral Penal del Ecuador

Resumen
En el presente trabajo de investigación, se propone “LA INCONSTITUCIONALIDAD DE LOS ANTECENDENTES PERSONALES, COMO REQUISITO EN LA SUSPENSION CONDICIONAL DE LA PENA, DENTRO DEL CODIGO ORGANICO INTEGRAL PENAL DEL ECUADOR”. La suspensión condicional de la pena, tiene como origen la Ley Belga, y aparece en esta el 31 de mayo de 1888 y la Ley Francesa del 26 de marzo 1891, en nuestro ordenamiento jurídico penal, aparece a partir del 14 de agosto del 2014, cuando entra en vigencia, el Código Orgánico Integral Penal, y se instaura en el art. 630 del COIP. La investigación se basará en concreto, en el numeral 3 del art. 630 del COIP, en donde como requisito aparecen los antecedentes personales del sentenciado, norma que ha sido legislada sin apego a la Constitución de la República del Ecuador, y que se torna discriminatoria por ser contraria a lo que estipulan los artículos 11 num. 2 que indica claramente.- Todas las personas son iguales y gozaran de los mismos derechos, deberes y oportunidades. Nadie podrá ser discriminado por razones de Pasado judicial o antecedentes penales. (Constitución. 2008), la ley sancionara toda forma de discriminación, en concordancia con el articulo 66numeral 4 de la C. R. E. que indica Derecho a la igualdad formal, igualdad material y no discriminación. La investigación se centrará, en la vulneración de derechos, principios y oportunidades, que acarrea el requisito de antecedentes personales.
In this research work, it is proposed "THE UNCONSTITUTIONALITY OF PERSONAL BACKGROUND, AS A REQUIREMENT IN THE CONDITIONAL SUSPENSION OF THE PENALTY, and WITHIN THE INTEGRAL PENAL ORGANIC CODE OF ECUADOR." The conditional suspension of the sentence has as its origin the Belgian Law, and appears in it on May 31, 1888 and the French Law of March 26, 1891, in our criminal legal system, appears as of August 14, 2014, when it enters into force, the Comprehensive Organic Criminal Code, and is established in art. 630 of the COIP. The investigation will be based specifically on numeral 3 of art. 630 of the COIP, where as a requirement the personal background of the sentenced person appears, a rule that has been legislated without adherence to the Constitution of the Republic of Ecuador, and which becomes discriminatory because it is contrary to what is stipulated in articles 11 num. 2 that clearly indicates.- All people are equal and will enjoy the same rights, duties and opportunities. No one may be discriminated against for reasons of judicial past or criminal record. (Constitution. 2008), the law will sanction all forms of discrimination, in accordance with article 66 number 4 of the C. R. E. which indicates the right to formal equality, material equality and non-discrimination. The investigation will focus on the violation of rights, principles and opportunities, which entails the requirement of personal background.
