Resumen
El presente trabajo de Titulación parte de una problemática social jurídica con relación al inmensurable aumento de violencia que atraviesa el País, en donde la Policía Nacional como Institución protectora de derechos, libertades y garantías de los ciudadanos, a través de sus agentes, se ven obligados a actuar de forma inmediata en escenarios donde se vea en peligro la vida de tercero o incluso poner en juego su integridad personal, cumpliendo a cabalidad su deber, el cual, en muchas ocasiones se pone en tela de duda su trabajo y en algunos casos son procesados.
De tal forma que nuestro material de estudio es analizar las diferentes perspectivas sobre la cual se pueda eximir de la Responsabilidad Penal de los agentes de la Policía Nacional en el cumplimiento de su deber o su obligación cuando se presenten escenarios que genere para la sociedad un peligro inminente a los derechos fundamentales reconocidos y garantizados por la Constitución y los Tratados internacionales de Derechos Humanos.
The present work of Titling starts from a legal social problem in relation to the immeasurable increase in violence that the country is going through, where the National Police as a Institution that protects the rights, freedoms and guarantees of citizens, through their agents, are forced to act immediately in scenarios where the life of a third party is endangered or even to put their personal integrity at stake, fully fulfilling their duty, which, in many cases their work is called into question and in some cases they are processed. In such a way that our study material is to analyze the different perspectives on which the Criminal Responsibility of the agents of the National Police can be exempted in the fulfillment of their duty or their obligation when scenarios arise that generate a danger for society imminent to the fundamental rights recognized and guaranteed by the Constitution and the International Human Rights Treaties.
