Resumen : En el Ecuador, una relación laboral se establece ante la celebración de un contrato de trabajo, el cual conlleva al cumplimiento de obligaciones y respeto de derechos que tienen tanto el empleador como el trabajador; cuando en ésta relación de trabajo, el trabajador incumple las obligaciones que tiene, al empleador le asiste el derecho de solicitar la terminación de la relación laboral a través de la aplicación de la figura legal del visto bueno, el mismo que es sustanciado por el Inspector de Trabajo, quien luego de una investigación determinará si la conducta del trabajador se adecuó o no a las causales de visto bueno establecidas en la normativa legal y quien autoriza o no la terminación del vínculo laboral; siendo la resolución emitida por el Inspector de Trabajo considerada un informe impugnable en la vía judicial ante el Juez de Trabajo. A diferencia de éste procedimiento normado en la legislación laboral ecuatoriana, existe la figura legal del despido justificado aplicado en la legislación laboral chilena, en la que es el empleador de manera unilateral quien da por terminada la relación laboral, ante el incumplimiento del trabajador a las obligaciones establecidas, sin someter dicha decisión a un tercero, el Inspector de Trabajo.
In Ecuador, an employment relationship is established before the conclusion of an employment contract, which entails the fulfillment of obligations and respect for rights that both the employer and the worker have; When in this employment relationship, the worker fails to comply with the obligations he has, the employer has the right to request the termination of the labor relationship through the application of the legal figure of the approval, which is substantiated by the Inspector of Labor, who after an investigation will determine if the worker's conduct was adapted or not to the grounds for approval established in the legal regulations and who authorizes or not the termination of the employment relationship; the resolution issued by the Labor Inspector being considered an objectionable report in the judicial process before the Labor Judge. Unlike this procedure regulated in Ecuadorian labor legislation, there is the legal figure of justified dismissal applied in Chilean labor legislation, in which it is the employer who unilaterally terminates the employment relationship, in the event of the worker's non-compliance with the Obligations established, without submitting said decision to a third party, the Labor Inspector, leaving the worker the right to appeal before the Labor Judge, in case of alleging an unjustified application of this legal figure and if this is proven, it will be imposed on the employer cancel the worker compensation which will be increased in percentage in accordance with the alleged cause for the termination of the employment relationship. In the contrast of the study of these two labor procedures, although we found some similarities, they also have marked differences, which at the time of analysis result to the benefit of both parties of the labor relationship, which include decongesting the Labor Inspectorate and speed in the justified dismissal process guaranteeing the right of workers. This research work seeks to achieve its objective, which consists of analyzing justified dismissal, by means of comparative law between the labor legislation of Ecuador and Chile, to prepare a bill that changes the legal figure of approval in Ecuador for just dismissal, applying a qualitative-descriptive methodology that, through the information collected in interviews, that support the feasibility of the subject studied,
