Implementación de Normativa en el Código Civil Ecuatoriano, en el Libro I Título VI, sobre la figura de la Unión de Hecho en base a la separación, liquidación y terminación de Sociedad de Bienes

Resumen
La Constitución del Ecuador reconoce a la familia y establece que la misma puede constituirse por unión de hecho, la misma que genera los mismos derechos y obligaciones que el matrimonio, sin embargo, en el matrimonio es posible tomar acuerdos referentes al contenido, administración y terminación de su patrimonio ya que posee un contenido normativo que garantiza a los cónyuges no habrá inseguridades; la unión de hecho presenta en cuanto a la sociedad de bienes es una ley subsidiaria a la del matrimonio, llevando a que el presente trabajo de titulación se desarrolle para establecer si existe la necesidad de independizar la figura jurídica de la Unión de Hecho respecto de la institución del matrimonio.
Logramos identificar los vacíos presentes en nuestro ordenamiento jurídico, y se elabora una propuesta de implementación de normativa que llene esos vacíos legales y logre que la unión de hecho goce de autonomía.
The Constitution of Ecuador recognize the family and it establishes that it can be constituted by the facto union, this generate the same rights and obligations as marriage, however, in the marriage is possible take referents agreements regarding content, administration and termination of your state, since it has a broad normative content that guarantee spouses that there will be no insecurities; the facto union it simply presents as for the real assets society a subsidiary law to the marriage law, leading to the fact that the present degree work is developed in order to stablish if there is a need to make the legal figure independent of the facto union respect marriage institution, due to the legal gaps that it present in our legal system. We can identify the gaps present in our legal system, and it present a proposal of normative implementation that fills in the legal gaps and achieve the facto union enjoys autonomy.
