Resumen
El propósito de este trabajo es, que al plantear la necesidad de resolver un problema latente el
cual no ha sido resuelto y talvez ni si quiera estudiado, pero que al enfrentarnos de manera tan
frontal a una Pandemia como el COVID-19, y el levantamiento del mes de Octubre del 2019,
partiendo de esta referencia en la cuál es necesario las consideraciones Jurídicas que deben
orientar y contener el estado de excepción en el Ecuador, con el propósito de conocer el origen,
comprender la definición, distinguir los elementos de régimen jurídico, saber definir críticas, y a
través de recomendaciones pertinentes poder reorientar, para así regular eficazmente el estado
de excepción, y con un enfoque claro manejar una metodología, que permita obtener los
respectivos resultados, de esa manera finalmente obtener el entendimiento necesario del
estado de excepción en el Ecuador, y en conclusión podamos adquirir el debido conocimiento a
través de la comprensión de estudios realizados como este, que llevan a la consideración Jurídica
del ya nombrado Estado de Excepción.
The purpose of this work is that by raising the need to solve a latent problem which has not been solved and perhaps not even studied, but that by facing a Pandemic such as COVID-19, and the uprising of the month of October 2019, starting from this reference in which the legal considerations that should guide and contain the state of exception in Ecuador are necessary, in order to know the origin, understand the definition, distinguish the elements of the legal regime , to know how to define criticisms, and through pertinent recommendations to be able to reorient, in order to effectively regulate the state of exception, and with a clear focus handle a methodology, that allows to obtain the respective results, thus finally obtaining the necessary understanding of the state of exception in Ecuador, and in conclusion we can acquire due knowledge through the understanding of studies carried out like this one, which will lead to the legal consideration of the already named State of Exception.
