Efectividad de las medidas de protección en los delitos de violencia intrafamiliar contra la mujer

Resumen
La presente investigación tuvo como objetivo general determinar si el Estado ecuatoriano
cumple con las medidas de protección a las mujeres, víctimas de violencia intrafamiliar,
en la garantía y efectividad a la protección de los derechos fundamentales de la mujer,
frente al debido proceso, para ello se determinó si las medidas de protección a la mujer,
víctima de violencia intrafamiliar, en el ejercicio del debido proceso, cumplen en
garantizar los derechos fundamentales de la víctima, también si las medidas de protección
a la mujer, víctima de violencia intrafamiliar, frente a las instituciones del Estado,
cumplen con el principio de eficacia en la solución del conflicto social que genera el delito
y por último se estableció cuál ha sido el fortalecimiento de las instituciones del Estado
ecuatoriano, en las medidas de protección con el fin de prevenir los crímenes de violencia
intrafamiliar. La metodología utilizada estuvo sustentada en el enfoque cualitativo al
momento de efectuar los análisis doctrinales, legales y de las entrevistas realizadas en
profundidad. La investigación a los efector de resolver el problema planteado propuso se
cree la oficina nacional de seguimiento al cumplimento de las medidas de protección
dictadas en beneficio de la mujer y del grupo familiar, cuya función será velar
periódicamente por la efectividad y cumplimiento de las medidas de protección que se
dicten tanto en sede judicial y administrativa.
The present investigation had as general objective to determine if the Ecuadorian State complies with the protection measures for women, victims of domestic violence, in the guarantee and effectiveness of the protection of the fundamental rights of women, against due process, for it it was determined whether the protection measures for women, victims of domestic violence, in the exercise of due process, comply with guaranteeing the fundamental rights of the victim, also if the protection measures for women, victims of domestic violence, against the institutions of the State, comply with the principle of effectiveness in the solution of the social conflict that generates the crime and finally it was established what has been the strengthening of the institutions of the Ecuadorian State, in the measures of protection in order to prevent crimes of domestic violence. The methodology used was based on the qualitative approach was used at the time of conducting the doctrinal, legal and interview analyzes made in depth. The investigation to the effector of solving the raised problem proposed the creation of the national office of follow-up to the fulfillment of the protection measures dictated for the benefit of the woman and the family group, whose function will be to periodically watch over the effectiveness and fulfillment of the protection measures. protection that are issued both in court and administrative.
