Resumen
En Ecuador, la declaratoria de Estado de Excepción es una medida excepcional que
permite al gobierno tomar acciones inmediatas para garantizar la seguridad y el
bienestar de la población. Esta medida se encuentra regulada en la Constitución de la
República, se pueden suspender ciertos derechos y garantías constitucionales, como la
libertad de circulación, la inviolabilidad de la vivienda y la libertad de asociación, entre
otros, la presente investigación tiene como finalidad analizar constitucionalidad de
declaratoria de Estado de Excepción en la Función Judicial, para ello se tiene como
revisión metodológica en análisis del Decreto Ejecutivo 872 y el dictamen 008-11-DEECC de la Corte Constitucional, que si bien este decreto fue declarado constitucional por
parte de los magistrados, fueron observado a través de los votos salvados.
