La Falta de Regulación Legal de Emprendimientos Digitales y su Repercusión en los Derechos del Consumidor

Resumen
El presente trabajo de investigación pretende demostrar la carencia de regulación legal
que actualmente afecta a los emprendimientos digitales en nuestro país y cómo esta
situación repercute en los derechos de los consumidores, derechos que están
consagrados en la Constitución de la República del Ecuador. En la era digital actual, es
crucial que los derechos de los consumidores en el ámbito digital sean abordados de
manera integral. El ámbito legal debe evolucionar para adaptarse a las cambiantes
necesidades de las personas ya la naturaleza dinámica del entorno en el que operan.
Dado que vivimos en una época digitalizada a nivel global, resulta esencial contar con
una normativa que sea acorde a estas circunstancias. En este contexto, el propósito
principal de este trabajo consiste en fortalecer la estructura normativa que rige el
comercio electrónico y protege los derechos de los consumidores en Ecuador. En
nuestro país, los pilares legales que sustentan esta área son la Ley de Comercio
Electrónico, Firmas Electrónicas y Mensajes de Datos, así como la Ley Orgánica de
Defensa del Consumidor. Para lograr esto, se propondrá la implementación de
mecanismos que no solo otorguen una mayor seguridad jurídica a los consumidores,
sino que también impongan mayores responsabilidades a los proveedores de servicios
o productos que operan en plataformas digitales. De esta manera, se aspira a establecer
relaciones comerciales más equitativas y justas para ambas partes involucradas.
This thesis has the objective of proving the lack of regulations within Ecuadorian law, in regards of digital businesses. Additionally aims to determine how the lack of regulations negatively impacts digital businesses and consumers. In the digital era it is crucial to regulate every aspect concerning new technologies and procedures that can affect or cause an impact in society and human life. Society, due to its dynamic nature, is in constant evolution; therefore, laws and regulations must adapt to changes in order to satisfy the needs of society. In this context, the main purpose of this investigation is to reinforce the legal system that regulates e-commerce and to strengthen consumers’ rights. In order to achieve this purpose, this investigation propose new mechanisms that not only provides more security and protection, but it also imposes new obligations and responsibilities to entrepreneurs and business owners that operates in digital platforms, this will allow to stablish fair and equal conditions in relationships between consumers and enterprises.
