Evaluación del nivel de efectividad de los acuerdos de Mediación respecto al Derecho de Alimentos.

Resumen
La mediación se constituye como uno de los mecanismos extrajudiciales de solución de conflictos. Los
juristas comparten el criterio que, a través de esta forma, se omite un proceso que implicaría mayor
inversión de tiempo y recursos, para obtener un resultado similar al que se logre mediante una
audiencia de mediación. El problema radica en que las partes que logren llegar a un acuerdo, no
cumplen a cabalidad lo expuesto en las actas de mediación, esta situación encuentra mayor
vulnerabilidad, cuando los acuerdos versan sobre los derechos de percibir alimentos de los hijos. A
través, de metodologías cualitativas, se ha desarrollado este trabajo de titulación, cuya finalidad es
proponer una solución normativa que encauce las conductas para un correcto cumplimiento de los
acuerdos de mediación en beneficio de los hijos menores. Para ello, se tuvo que recurrir al estudio de
campo a través de entrevistas, mismas que como resultado, han permitido desarrollar una propuesta de
reforma a la Ley de Arbitraje y Mediación, con el objetivo que se defienda los intereses de los hijos que
perciben una pensión de alimentos.
Mediation is one of the extrajudicial conflict resolution mechanisms. Jurists share the criterion that, through this form, a process that would imply a greater investment of time and resources is omitted, in order to obtain a similar result to the one achieved through a mediation hearing. The problem lies in the fact that the parties who manage to reach an agreement do not fully comply with what is set forth in the mediation minutes; this situation is more vulnerable when the agreements deal with the right to receive child support. Through qualitative methodologies, this degree work has been developed, whose purpose is to propose a normative solution that channels the conducts for a correct compliance with the mediation agreements for the benefit of the minor children. For this purpose, it was necessary to resort to a field study through interviews, which as a result, have allowed the development of a proposal to reform the Arbitration and Mediation Law, with the objective of defending the interests of children who receive child support.
