El abuso sexual infantil es una grave violación de los derechos humanos que afecta de manera significativa el bienestar físico, psicológico y emocional de los niños y niñas. El objetivo principal de esta investigación es evaluar la efectividad de los mecanismos de defensa y apoyo existentes en el sistema penal ecuatoriano para brindar protección y justicia a las víctimas de abuso sexual infantil. Se examinarán tanto los aspectos legales y normativos como las prácticas y procedimientos implementados en la materia. En primer lugar, se llevará a cabo una revisión exhaustiva de la legislación nacional e internacional relacionada con el abuso sexual infantil, para identificar el marco legal y normativo vigente y analizar su pertinencia y adecuación para abordar eficazmente el abuso sexual infantil. A continuación, se realizará un análisis de los mecanismos de defensa disponibles en el sistema penal ecuatoriano, como los procesos judiciales, las garantías procesales para las víctimas, la participación de los actores involucrados (jueces, fiscales, abogados, psicólogos, entre otros) y la existencia de programas de protección a las víctimas. La investigación se llevará a cabo mediante un enfoque mixto que incluirá revisión documental, análisis de casos judiciales y entrevistas a profesionales del sistema penal involucradas en la protección de los derechos de los niños y niñas. Los resultados obtenidos se utilizarán para identificar las fortalezas y debilidades del sistema penal ecuatoriano en relación con la protección y justicia para las víctimas de abuso sexual infantil. Además, se propondrán recomendaciones y mejoras que permitan fortalecer los mecanismos de defensa y apoyo existentes, promoviendo así una respuesta más efectiva y adecuada a esta problemática en el contexto This study focuses on analyzing the defense and support mechanisms available to victims of child sexual abuse in the Ecuadorian penal system. The legal and normative aspects will be examined as well as the practices and procedures implemented in this area. First, a comprehensive review of national and international legislation related to child sexual abuse will be carried out to identify the current legal and regulatory framework and analyze its relevance and adequacy to effectively address child sexual abuse. This will be followed by an analysis of the defense mechanisms available in the Ecuadorian criminal system, such as judicial processes, procedural guarantees for victims, the participation of the actors involved (judges, prosecutors, lawyers, psychologists, among others) and the existence of victim protection programs. The research will be carried out through a mixed approach that will include documentary review, analysis of judicial cases and interviews with professionals of the criminal justice system involved in the protection of children's rights. The results obtained will be used to identify the strengths and weaknesses of the Ecuadorian penal system in relation to protection and justice for victims of child sexual abuse.
