Resumen
La presente tesis tiene como finalidad de analizar la homologación de las sentencias y resoluciones extranjeras, orden público interno, así como su aplicación en el Ecuador. Así mismo describir el procedimiento para homologar el fallo extranjero que ha sido emitido por un órgano judicial de otro Estado, cuya finalidad es que sea reconocida y ejecutada por el Estado receptor. Para solicitar la homologación u exequátur de un fallo extranjero, en el Ecuador, el solicitante debe cumplir con los requisitos establecido en el Código de Procedimiento Civil Ecuatoriano y en el Código Orgánico de la Función Judicial del Ecuador. Las Salas Especializadas de las Cortes Provinciales de Justicia del Ecuador, son únicas para conocer y resolver los fallos extranjeros previo al examen que se aplica a toda resolución extranjera. Así mismo, analizan que dicho fallo no lesione el orden público interno, pese a ser un concepto jurídico relativo, es uno de los principales elementos para reconocer los fallos extranjeros. En el desarrollo de la presente investigación, se ha considerado la investigación bibliográfica, entrevistas y encuestas a los estudiantes de sexto nivel de la Facultad de Jurisprudencia, Ciencias Sociales y Políticas de la Universidad de Guayaquil. El estudio se realizó mediante una investigación Descriptiva-Explicativa y Analítica-Sintética. Los resultados obtenidos de la investigación, muestran que existe una falta de interés, para difundir el procedimiento para homologar un fallo extranjera. Es muy importante que los estudiantes, profesionales del derecho y ciudadanía en general, conozcan el procedimiento de homologación de un fallo extranjero. El Consejo de la Judicatura del Ecuador, Facultad de Jurisprudencia, Ciencias Sociales y Políticas de la Universidad de las Universidades del Ecuador y el Colegio de Abogados del Guayas, deben poner en conocimiento los requisitos y el procedimiento para homologar una sentencia extranjera
This thesis aims to analyze the approval of foreign judgments and decisions, internal public order as well as its application in Ecuador. Also describe the procedure to approve the foreign judgment has been issued by a court of another State, whose purpose is to be recognized and enforced by the receiving State. To request approval or enforceability of a foreign judgment in Ecuador, the applicant must meet the requirements set out in the Code of Civil Procedure Ecuador and the Organic Code of the Judicial Function of Ecuador. The Specialized Meeting of the Provincial Courts of Justice of Ecuador, are unique to hear and determine foreign judgments before the test that applies to all foreign judgment. Likewise, analyze such failure does not damage the internal public order, despite being a legal concept relative, is one of the main elements to recognize foreign judgments. In the development of this investigation, it was considered bibliographic research, interviews and surveys to students in sixth level of the Faculty of Law, Social and Political Sciences at the University of Guayaquil. The study was conducted using a descriptive-explanatory and Analytic-Synthetic research. The results of research show that there is a lack of interest, to disseminate the procedure to approve a foreign judgment. It is very important that students, legal professionals and the general public, know the procedure for approval of a foreign judgment. The Judicial Council of Ecuador, Faculty of Law, Social and Political Sciences of the University of the Universities of Ecuador and Guayas Bar Association should make known the requirements and procedure to approve a foreign judgment.
