Resumen
La Sentencia No.245 emitida por la Corte Interamericana de Derechos Humanos, contribuye a la evolución del Derecho Internacional de los Derechos Humanos referentes a los Derechos Colectivos de los Pueblos, Nacionalidades y Comunidades Indígenas, de manera que fortalece el Derecho a la consulta Previa, Libre e Informada, así como a la protección de sus territorios ancestrales y el Derecho a la Vida y a la Integridad. Esta investigación tiene como objetivo, establecer la protección de los Pueblos, Comunidades y Nacionalidades Indígenas, en el ámbito de derechos humanos, garantizar que se cumpla con la consulta previa en los programas o proyectos que tengan incidencia en sus territorios y en su forma de vida por consiguiente la CIDH ratifica la responsabilidad de los Estados de garantizar los Derechos mencionados mediante estándares que se encarguen de fortalecer la jurisprudencia.
Judgment No. 245 issued by the Inter-American Court of Human Rights contributes to the evolution of International Human Rights Law regarding the Collective Rights of Indigenous Peoples, Nationalities and Communities, thereby strengthening the Right to Free, Prior and Informed Consultation, as well as the protection of their ancestral territories and the Right to Life and Integrity. The objective of this investigation is to establish the protection of Indigenous Peoples, Communities and Nationalities in the area of human rights, to ensure compliance with prior consultation in programs or projects that have an impact on their territories and their way of life. Consequently, the IACHR ratifies the responsibility of States to guarantee the aforementioned Rights through standards that are responsible for strengthening jurisprudence.
