Resumen
El presente trabajo de investigación se circunscribe a demostrar la práctica abusiva de la
causal de caso fortuito o fuerza mayor amparada en el Código del Trabajo, artículo 169, numeral
6, en el contexto de la crisis económica generada por la pandemia COVID-19 durante el año
2020. Las consecuencias jurídicas de la indiscriminada e injustificada aplicación de esta figura
recaen en el trabajador, quien ha sido directamente perjudicado, violentándose sus derechos,
debido a que dichas desvinculaciones justificadas bajo la causal en mención se configuran en
despidos intempestivos. Además, la Disposición Interpretativa de la Ley Orgánica de Apoyo
Humanitario, es inconstitucional y regresiva en derechos, mismos que están garantizados
también en acuerdos internacionales.
The present research work is limited to demonstrate the abusive practice of the cause of fortuitous event or force majeure protected in the Labor Code, article 169, numeral 6, in the context of the economic crisis generated by the COVID-19 pandemic during the year 2020. The legal consequences of the indiscriminate and unjustified application of this figure fall on the worker, who has been directly harmed, violating his rights, due to the fact that such terminations justified under the aforementioned cause are configured as untimely dismissals. Furthermore, the Interpretative Provision of the Organic Law of Humanitarian Support is unconstitutional and regressive in rights, which are also guaranteed in international agreements.
