La idoneidad jurídica en la elección de Asambleístas en la República del Ecuador

Resumen
El presente trabajo de investigación, titulado como “LA IDONEIDAD JURÍDICA EN LA
ELECCIÓN DE ASAMBLEÍSTAS EN LA REPÚBLICA DEL ECUADOR”, surge de los
diferentes cambios y transformaciones sociales -dentro del contexto histórico actual- que
amenaza con destruir el Estado de Derechos y Justicia, como consecuencia del abuso de
las organizaciones políticas al proponer ciudadanos carismáticos pero incapaces, sin
conocimiento alguno sobre las funciones a desempeñar, todo esto, debido a los básicos
requisitos que establece la Constitución para ostentar la representación como legislador.
Varios intentos, conforme el marco jurídico lo establece, se han realizado por la vía
reforma constitucional habiendo sido analizado y declarado por la Corte Constitucional
como inconstitucionales. Sin embargo, esos cambios sociales, demandan imperantemente
de legisladores probos e idóneos, capaces de actuar en función de los intereses generales
de la sociedad, negándose a que dogmas o ideologías fecunden intereses particulares que
amenacen con destruir su institucionalidad, y consecuentemente, la democracia, la
deslegitimación institucional que ha tenido la Asamblea Nacional, nos lleva como
mandantes a exigir mecanismos alternativos que fortalezcan el sistema parlamentario, por
lo cual es necesario realizar un cambio en el artículo 119 de la Carta Magna, y se ha
propuesto realizar un proyecto de enmienda constitucional vía referéndum, que viabilice
el requisito de idoneidad jurídica en la normativa constitucional sin que esta represente
restricción de derechos y garantías, solicitándole a la Corte Constitucional emita el
dictamen de procedimiento conforme el artículo 99 de la LOGJC, dando apertura al
candado normativo de los tres requisitos constitucionales, para que una vez enmendada
la constitución, se pueda reformar los cuerpos legales en materia electoral, con el fin de
ir mejorando el sistema legislativo ecuatoriano, encaminados al establecimiento la
idoneidad jurídica en los asambleístas de la República del Ecuador.
The present research work, called "LEGAL SUITABILITY IN THE ELECTION OF ASSEMBLYMEN IN THE REPUBLIC OF ECUADOR," comes from the different social transformations and changes- within the current historical context - that threaten to destroy the State of Rights and Justice, as a result of the abuse of political organizations for giving the power to charming people but, without any knowledge of what functions need to be executed, due to the low level of requirements established by the Constitution to become a legislator. There have been made several attempts through the constitutional reform which have been analyzed and declared unconstitutional by the Constitutional Court. However, these social changes demand wise and suitable legislators, capable of acting within the general interests of society, rejecting their dogmas or personal interests that threaten to destroy the institutionalist, and consequently, the democracy. The weak institutional image that the National Assembly has had leads us as Ecuadorians to demand alternative mechanisms that strengthen the parliamentary system, which is why it is necessary to make a change in article 119 of the Magna Carta, also there has been proposed to carry out reformer project referendum, that can become true the requirement of legal suitability in the constitutional regulations without having a restriction of rights and guarantees, requesting the Constitutional Court to issue the procedural opinion in accordance with article 99 of the LOGJC, opening the regulatory lock of the three constitutional requirements, so, once the constitution is reformed, the legal bodies in electoral matters can be modified, in order to improve the Ecuadorian legislative system, going forward to establishing legal suitability in the assembly members of the Republic of Ecuador.
