Resumen
En este trabajo de investigativo busca demostrar el peligro al que se expone la objetividad e imparcialidad de los administradores en un proceso administrativo, dejando en absoluta vulneración las garantías que le otorga la constitución. Es por esto que expondré el rol que deberían de cumplir los servidores públicos haciendo uso de la autonomía procesal que le corresponde al Estado.
Será primordial respetar la igualdad ante la ley, garantizando que se cumplirá el debido proceso y la seguridad jurídica, demostrando la prohibición expresa de que el juez no podrá resolver en favor de algún interés en manifiesto dentro de un proceso administrativo, impidiendo de esta forma que sea juez cuando ponga en manifiesto su resolución. Pondré a conocimiento cada organismo que respalda y brinda la garantía que se requiere para llevar a cabo el cumplimiento de los deberes del Estado respaldados en la Constitución.
This research work wants to demonstrate the danger of the objectivity and impartiality of the managers are exposed in an administrative process, leaving in absolute violation of the warranties granted by the constitution. This is the reason why I am going to expose in this writing the role that the public workers should do by making use of the procedural autonomy that corresponds to the state. It’s essential to respect equality before the law, guaranteeing that due process and legal security certainty will be complied with, demonstrating the express prohibition that the judge will not be able to resolve in favor of any interest in manifest within an administrative process, preventing him from being a judge when he makes his resolution manifest. I will make known each organism that supports and provides the guarantee that is required to carry out the fulfillment of the duties of the state supported in the constitution.
