Resumen
El constante recibimiento de correos electrónicos por parte de empresas privadas, con las cuales se mantiene una relación contractual, condicionando el servicio o producto previamente pactado a la aceptación del tratamiento de información es un problema creciente en estos tiempos. Por lo que, a través de la presente investigación, titulada como DERECHO A LA INTIMIDAD, DERECHOS CONTRACTUALES Y OBLIGATORIEDAD DE LA POLÍTICA DE PRIVACIDAD DE EMPRESAS DE PRESTACIÓN DE SERVICIOS, se busca la solución al problema planteado, lo cual conlleva al análisis doctrinal y legal respecto al derecho constitucional de la intimidad, así como a la libertad de contratación, para poder determinar ciertos límites dentro de las relaciones contractuales. Nuestro objetivo general es determinar cómo se protege el derecho a la intimidad frente a la obligatoriedad de la política de privacidad de empresas de prestación de servicios para acceder a los derechos contractuales. Consecuentemente, se utilizó una metodología de investigación cualitativa, así como se tomaron como fuentes de referencia la sentencia No. No. 2064-14-EP/21 y la sentencia No. 002-11-SIN-CC dictadas por la Corte Constitucional del Ecuador. Por lo que, las investigadoras solucionan el problema planteado con una reforma a la Ley de Protección de Datos Personales, donde se prohíba la coacción por parte de las empresas a los contratantes para aceptar el tratamiento de información, las respectivas sanciones, así como el percibir beneficios pecuniarios en caso de consentir que se venda la información.
The constant receipt of emails from private companies, with which a contractual relationship is maintained, conditioning the previously agreed service or product to the acceptance of information processing is a growing problem these days. Therefore, through this research, titled RIGHT TO PRIVACY, CONTRACTUAL RIGHTS AND MANDATORY OF THE PRIVACY POLICY OF SERVICE PROVISION COMPANIES, the solution to the problem raised is sought, which leads to doctrinal analysis. and legal with respect to the constitutional right to privacy, as well as freedom of contract, in order to determine certain limits within contractual relationships. Our general objective is to determine how the right to privacy is protected against the mandatory privacy policy of service provision companies to access contractual rights. Consequently, a qualitative research methodology was used, as well as ruling No. No. 2064-14-EP/21 and ruling No. 002-11-SIN-CC issued by the Constitutional Court of Ecuador were taken as reference sources. Therefore, the researchers solve the problem raised with a reform to the Personal Data Protection Law, which prohibits coercion by companies on contractors to accept the processing of information, the respective sanctions, as well as receiving pecuniary benefits if you consent to the information being sold.
