Resumen
La investigación aborda la preocupante vulneración del principio del Interés Superior
del Niño en los procesos judiciales de adopción en Ecuador, y propone medidas para agilizar
y garantizar el bienestar de los menores. Se destaca la importancia del principio respaldado
por la Convención Internacional sobre los Derechos del Niño y se propone reformas en el
Código de la Niñez y Adolescencia (en adelante CNA) para cumplir con los plazos
establecidos. El capítulo II ofrece el marco teórico con antecedentes, precedentes históricos,
recomendaciones y marco legal. El capítulo III describe la metodología, una combinación de
enfoques exploratorios y descriptivos, utilizando métodos cuantitativos y cualitativos para
recopilar datos de actores involucrados y parejas interesadas en adoptar. El capítulo IV
presenta una propuesta para implementar un inciso en el artículo 158 del CNA, asignando un
único juez especializado para agilizar el proceso de adopción. Se concluye que la demora
afecta negativamente a los niños y se recomienda la capacitación, inversión en recursos y
seguimiento a las familias adoptivas. La aplicación efectiva del principio asegurará el
desarrollo integral y el bienestar emocional de los niños adoptados.
The research addresses the concerning violation of the principle of the Best Interest of the Child in adoption judicial processes in Ecuador and proposes measures to expedite and ensure the well-being of minors. The importance of the principle, supported by the International Convention on the Rights of the Child, is highlighted, and reforms in the Code of Childhood and Adolescence are suggested to meet established deadlines. Chapter II provides the theoretical framework with antecedents, historical precedents, recommendations, and legal framework. Chapter III describes the methodology, a combination of exploratory and descriptive approaches, using quantitative and qualitative methods to gather data from involved actors and couples interested in adoption. Chapter IV presents a proposal to implement a section in Article 158 of the Organic Code of Childhood and Adolescence, assigning a specialized judge to expedite the adoption process within a maximum of 45 days. It is concluded that delays negatively affect children, and training, investment in resources, and follow-up to adoptive families are recommended. The effective application of the principle will ensure the comprehensive development and emotional well-being of adopted children.
