Resumen
El presente trabajo de titulación estudia el fenómeno de la reincidencia en el delito vinculada a la discriminación por pasado judicial que se presenta como un desafío tanto de una perspectiva jurídica como social. Desde el punto de vista jurídico, se plantea examinar el alcance de la Constitución y el Código Orgánico Integral Penal para abordar el tema de la reincidencia sin perpetuar la discriminación y estigmatización de las personas con antecedentes penales. Se centra además en analizar las leyes, y las estrategias implementadas para prevenir la repetición delictiva y promover la reintegración social de las personas privadas de la libertad. Desde el punto de vista social, la investigación se sumerge en las causas subyacentes de la reincidencia, especialmente, aquellas que están conexas a la discriminación. Esta tesis busca proponer medidas para formar una sociedad más inclusiva con las personas con pasado judicial que reconozca la importancia del proceso rehabilitador y la eliminación de la discriminación en la reinserción de este grupo de personas
The present degree work studies the phenomenon of recidivism in crime linked to discrimination due to judicial past, which is presented as a challenge from both a legal and social perspective. From the legal point of view, it is proposed to examine the scope of the Constitution and the Comprehensive Organic Criminal Code to address the issue of recidivism without perpetuating discrimination and stigmatization of people with criminal records. It also focuses on analyzing the laws and strategies implemented to prevent crime repetition and promote the social reintegration of people deprived of their liberty. From the social point view, this research delves into the underlying causes of recidivism, especially those that are related to discrimination. This thesis seeks to propose measures to form a more inclusive society with people with a judicial past that recognizes the importance of the rehabilitative process and the elimination of discrimination in the reintegration of this group of people.
