Resumen
El estudio de caso que se analizará en el presente trabajo toma como fuente
jurisprudencial la interpretación de la Corte Constitucional en la Sentencia No. 1024-19-JP/21 y
Acumulados donde se confirma posibles vulneraciones a los afiliados que había incurrido el
Instituto Ecuatoriano de Seguridad Social, puesto que en estos casos se justificaba la vulneración
a los derechos por la responsabilidad patronal, y así se negaron prestaciones a grupos prioritarios
y todos los derechos que corresponden por estar afiliado a la institución como lo son la
discapacidad, viudez y orfandad, afectando a los derechos a la seguridad social, la vida digna, la
atención prioritaria y al acceso a servicios de calidad, eficientes, efectivos y de buen trato,
además se toma en consideración la constitucionalidad del artículo 94 de la Ley de Seguridad
Social.
The case study that will be analyzed in this work takes as a jurisprudential source the interpretation of the Constitutional Court in Judgment No. 1024-19-JP / 21 and Joined where possible violations to the affiliates that the Ecuadorian Security Institute had incurred are confirmed. Social, since in these cases the violation of rights was justified by employer responsibility, and thus benefits were denied to priority groups and all the rights that correspond to being affiliated with the institution such as disability, widowhood and orphanhood, affecting to the rights to social security, a dignified life, priority attention and access to quality, efficient, effective and well-treated services, in addition, the constitutionality of article 94 of the Social Security Law is taken into consideration.
