Derechos digitales y privacidad en Ecuador: explorando la regulación del derecho de identidad digital

Resumen
En la actualidad diversas entidades tecnológicas están creando espacios de interacción virtual donde las personas a través de plataformas y medios digitales están proporcionando datos inherentes a la identidad para la creación de un perfil. Por lo que, a través de la presente investigación, titulada como DERECHOS DIGITALES Y PRIVACIDAD EN ECUADOR: EXPLORANDO LA REGULACIÓN DEL DERECHO DE IDENTIDAD DIGITAL, se analiza de forma doctrinal, legal y convencional sobre la protección y regulación a la identidad digital, que si bien, los derechos humanos están enfocados en el entorno físico, deberían de migrar a la esfera digital para una máxima protección al individuo en estos nuevos espacios digitales. Nuestro objetivo general es determinar cómo se protege el derecho a la identidad digital frente a la implementación de las nuevas tecnologías en el Ecuador. Consecuentemente, se aplicó una metodología con un diseño de investigación cualitativa. Para esto, se ha considerado de forma referencial la sentencia No. 456-20-JP/21 y la sentencia No. 2064-14- EP/21 dictaminadas por la Corte Constitucional del Ecuador. Por lo tanto, se aborda el problema con la creación de una ley de regulación de identidad digital y datos personales donde se establezca que las entidades que deseen operar en el país deberán obtener una certificación y registro de datos de las personas que deseen navegar en sus plataformas con sus nombres reales con el objetivo de poder crear distintos perfiles y poder reducir la brecha digital ante el mal manejo de estas nuevas plataformas digitales
Currently, various technological entities are creating spaces for virtual interaction where people, through digital platforms and media, are providing data inherent to identity for the creation of a profile. Therefore, through this research, entitled DIGITAL RIGHTS AND PRIVACY IN ECUADOR: EXPLORING THE REGULATION OF THE RIGHT TO DIGITAL IDENTITY, it is analyzed in a doctrinal, legal and conventional way on the protection and regulation of digital identity, that although human rights are focused on the physical environment, they should migrate to the digital sphere for maximum protection of the individual in these new digital spaces. Our general objective is to determine how the right to digital identity is protected in the face of the implementation of new technologies in Ecuador. Consequently, a methodology with a qualitative research design was applied. To this end, judgment No. 456-20-JP/21 and judgment No. 2064-14-EP/21 issued by the Constitutional Court of Ecuador have been considered as references. Therefore, the problem is addressed with the creation of a law for the regulation of digital identity and personal data where it is established that entities that wish to operate in the country must obtain a certification and data registration of people who wish to browse their platforms with their real names in order to be able to create different profiles and be able to reduce the digital divide in the face of the mismanagement of these new ones digital platforms.
