Resumen
El análisis se centra en la identificación y evaluación de las violaciones de contratos por temporada en el marco del Código del Trabajo ecuatoriano. Se identificaron ambigüedades en la definición de contratos por temporada en el Código del Trabajo, contribuyendo a interpretaciones variadas y posibles abusos. Existe evidencia de un uso indebido de contratos por temporada, desviándose de su propósito original y afectando la estabilidad laboral de los trabajadores. Los trabajadores bajo contratos por temporada enfrentan desigualdades en beneficios y condiciones laborales en comparación con
con contratos a tiempo completo. La falta de límites claros en la duración de los contratos por temporada contribuye a la inseguridad laboral y a situaciones de explotación. Los trabajadores encuentran obstáculos al intentar resolver disputas relacionadas con contratos por temporada, evidenciando carencias en los mecanismos actuales. Se destaca la importancia de una revisión periódica de la legislación laboral para abordar las dinámicas cambiantes del mercado. La participación activa de empleadores, trabajadores y expertos legales se plantea como crucial para la formulación de reformas

efectivas. Las violaciones de contratos por temporada tienen un impacto significativo en la estabilidad laboral de los trabajadores, afectando tanto su seguridad financiera como emocional. Se reconoce la necesidad de encontrar un equilibrio entre las necesidades de los empleadores y la protección de los derechos laborales en cualquier propuesta de reforma. En resumen, el análisis destaca la urgencia de abordar las deficiencias en la definición, protecciones laborales y mecanismos de resolución de disputas asociados con los contratos por temporada en Ecuador. Se propone una revisión integral de la legislación, con especial énfasis en la participación activa de todas las partes interesadas y la consideración del impacto económico y social.
The analysis focuses on the identification and evaluation of violations of seasonal contracts within the framework of the Ecuadorian Labor Code. Ambiguities were identified in the definition of seasonal contracts in the Labor Code, contributing to varied interpretations and possible abuses. There is evidence of improper use of seasonal contracts, deviating from their original purpose and affecting the job stability of workers. Workers on seasonal contracts face inequalities in benefits and working conditions compared to those on full-time contracts. The lack of clear limits on the duration of seasonal contracts contributes to job insecurity and exploitation. Workers encounter obstacles when trying to resolve disputes related to seasonal contracts, evidencing shortcomings in current mechanisms. The importance of a periodic review of labor legislation is highlighted to address changing market dynamics. The active participation of employers, workers and legal experts is considered crucial for the formulation of effective reforms. Seasonal contract violations have a significant impact on workers' job stability, affecting both their financial and emotional security. The need to find a balance between the needs of employers and the protection of labor rights in any reform proposal XXI is recognized.
