Resumen
El propósito de este trabajo de investigación es demostrar las falencias que presentan los procesos de adopción en sus fases administrativas y judiciales, en donde se encuentran mayormente afectados los niños mayores a 7 años, producto de la burocracia que no les permite gozar de una familia en los tiempos estimados. Se empleó una metodología cualitativa porque se analizaron e interpretaron las opiniones de expertos relacionados en esta materia. Los resultados constatan una falta de celeridad en las fases que componen el proceso de adopción, desestabilizando el efectivo goce del derecho a la familia y que, a los niños, niñas y adolescentes en orfandad, se les dificulte ser parte de un núcleo familiar. Finalmente, se pretende plantear una reforma al Código de la Niñez y Adolescencia, que adecue de manera precisa el interés superior de los niños en los procesos de adopción.

Due to the different opinions from the experts related to this subject. A quitative methodology was used. The results show us a Lack of speed in the phases that make up the adoption process destabilizing the effective enjoyment of the right to the family and making it difficult for orphaned children and teenagers to be part of a family unit. Finally, it is intended to propose a reform to the Organic Code of Children and Adolescents, which precisely adapts the best interests of children in adoption processes.
