Resumen
La presente investigación abordo el tema del enriquecimiento injusto en materia laboral y su ausencia de tipificación en el Código Orgánico Integral Penal, debido a que esta problemática es muy común y aborda situaciones en donde un individuo se beneficia injustamente a expensas de otro en el contexto laboral y no existe un tipo penal que pueda sancionar la conducta con la que se lo ejecuta.
El objetivo principal de la investigación fue describir el impacto que genera la falta de tipificación penal que sancione esta conducta, además de determinar una sanción mediante la tipificación en el Código Orgánico Integral Penal a las personas naturales o jurídicas por el cometimiento del delito de enriquecimiento injusto en materia laboral y lesionar los bienes jurídicos tutelados en la constitución.
Se planteó además una metodología con enfoque mixto, basándonos en el uso de elementos tanto de la investigación cuantitativa y cualitativa, gracias al método aplicado se pudo comprender las posturas teóricas que sustentaron la investigación mediante entrevistas y encuestas que indicaron que las personas desean que exista una reforma legal para el cumplimiento de sus derechos y se enfoquen en el enriquecimiento injusto en materia laboral.

De acuerdo al análisis de la investigación se concluye en que la gran mayoría de trabajadores desconoce sus derechos laborales y aquello provoca el abuso patronal a pesar de tener una Constitución garantista. Desean una reforma que sancioné de una manera más consistente al empleador mediante una reforma en el Código Orgánico Integral Penal y así evitar abusos y explotación a la que son sometidos.
The present inquiry delves into the subject of unjust enrichment in labor matters and its absence of codification in the Comprehensive Organic Penal Code. This lacuna arises as a prevalent issue, encapsulating scenarios where an individual unjustly benefits at the expense of another within the labor context, yet no penal provision exists to sanction such conduct. The primary objective of the investigation is to delineate the impact stemming from the lack of penal classification for this conduct. Furthermore, it aims to prescribe a penalty through the incorporation of a provision within the Comprehensive Organic Penal Code, holding individuals or legal entities accountable for the commission of the offense of unjust enrichment in labor matters and thereby infringing upon constitutionally protected legal interests. The research employs a mixed-methodology approach, amalgamating elements of both quantitative and qualitative research. Through applied methods such as XX interviews and surveys, theoretical perspectives supporting the investigation were comprehended. These interactions revealed a collective desire for a legal reform to uphold individual rights, with a specific focus on unjust enrichment in labor matters. Upon analysis of the research, it is concluded that a significant majority of workers are unaware of their labor rights, leading to employer exploitation despite constitutional safeguards There is a shared aspiration for a more robust legal framework, specifically within the Comprehensive Organic Penal Code, to consistently penalize employers and prevent the abuses and exploitation to which workers are subjected.
