Resumen
El presente estudio de investigación denominado “El Derecho al Reintegro por Despido
Discriminatorio a las Personas con Discapacidad como Protección a la Estabilidad Laboral”
analiza la aplicación del Derecho al Reintegro como garantía de los derechos fundamentales
del trabajador, con énfasis en los individuos que por su condición de discapacidad son
discriminados laboralmente e involucrados en despidos injustificados, omitiendo sus
capacidades y potencialidades en las tareas que puedan desempeñar. Dicha problemática
ignora lo establecido en la Carta Magna donde se afirma que las personas con discapacidad
son un grupo de atención prioritaria. Al momento de aplicar la figura jurídica del derecho al
reintegro se protege la estabilidad económica y laboral del trabajador con discapacidad, para
que dicho individuo, además de percibir una indemnización por daños y perjuicios, sea
reintegrado a su puesto de trabajo en el área que desempañaba antes de ser desvinculado de
sus funciones laborales.
This research study entitled "The Right to Reinstatement for Discriminatory Dismissal of Persons with Disabilities as Protection to Labor Stability" analyzes the application of the Right to Reinstatement as a guarantee of the fundamental rights of the worker, with emphasis on individuals who, due to their condition of disability, are discriminated at work and involved in unjustified dismissals, omitting their abilities and potentialities in the tasks they can perform. This problem ignores the provisions of the Magna Carta, which states that persons with disabilities are a group of priority attention. When applying the legal figure of the right to reinstatement, the economic and labor stability of the disabled worker is protected, so that such individual, in addition to receiving compensation for damages, is reinstated to his or her job in the area he or she was working in before being dismissed from his or her job.
