Resumen
Para la presente investigación se ha examinado las implicaciones jurídicas de las enfermedades catastrófica, su catalogación en los derechos humanos, el recogimiento en la doctrina y sus perspectivas en el régimen jurídico ecuatoriano de cara a los derechos y protección estatal que reconoce para este grupo humano el garantismo constitucional y su categorización como sujetos de atención prioritaria. En ese sentido se logra determinar que las personas con enfermedades catastróficas, raras, huérfanas, costosas y calamitosas son sujetos de derechos plenamente y por lo tanto necesidad del gozar de protección del Estado, por lo que el incumplimiento de las garantías de políticas públicas representa una vulneración a sus derechos constitucionales, para lo cual se determina que debe mejores mecanismos de rendición de cuenta y supervisión, los cuales se proponen mediante reforma a fin de optimizar la efectividad del sistema de indicadores de cumplimiento de derechos humanos ente sector de atención prioritaria.
This research has examined the legal implications of catastrophic diseases, their cataloguing in human rights, their inclusion in the doctrine and their perspectives in the Ecuadorian legal system with regard to the rights and state protection recognized for this human group by the constitutional guarantees and their categorization as subjects of priority attention. In this sense, it is determined that people with catastrophic, rare, orphan, costly and calamitous diseases are subjects of full rights and therefore need to enjoy the protection of the State, so that the breach of the guarantees of public policies represents a violation of their constitutional rights, for which it is determined that better mechanisms of accountability and supervision are needed, which are proposed through reform in order to optimize the effectiveness of the system of indicators of compliance with human rights in the priority care sector.
