Resumen
La presente investigación de caso lleva por título “El Derecho constitucional de petición y la acción por silencio administrativo en la justicia ecuatoriana”, trata sobre un análisis de las normativas legales relacionadas con el derecho de petición, la institución jurídica del silencio administrativo y la acción por silencio administrativo. De igual manera, se ha realizado un trabajo social en el que se ha concluido que actualmente la ciudadanía en general y especialmente en nuestra ciudad de Guayaquil tiene un alto porcentaje de desconocimiento a nivel de derechos y garantías. Asimismo, se ha recopilado información respecto de las acciones por silencio administrativo que se han presentado en el año 2017,a nivel nacional y en la provincia del Guayas, emitida por el Departamento de Estudios Jurimétricos y Estadística Judicial del Consejo de la Judicatura de la Provincia del Guayas, de la cual se ha inferido que la acción estudiada no es muy común. Y hemos planteado alternativas de solución encaminadas al fortalecimiento del derecho de petición y la tutela judicial efectiva en el caso de que se plantee la acción por silencio administrativo.
This case investigation is entitled "The constitutional right of petition and action for administrative silence in the Ecuadorian justice", is about an analysis of the legal regulations related to the right of petition, the legal institution of administrative silence and the action for administrative silence. In the same way, a social work has been carried out in which it has been concluded that currently the citizenship in general and especially in our city of Guayaquil has a high percentage of ignorance in terms of rights and guarantees. In fact, information has been collected regarding the administrative silence actions that have been presented in the year 2017, at the national level and in the province of Guayas, issued by the Department of Juridical Studies and Judicial Statistics of the Council of the Judiciary of Guayas Province, from which it has been inferred that the action studied is not very common. We have proposed alternative solutions aimed at strengthening the right of petition and effective judicial protection ifthe action is filed for administrative silence.
