Resumen
La investigación tiene como objetivo analizar el aborto en el Ecuador desde un punto de vista
bioético y cuál es el planteamiento jurídico. Para esto, la metodología aplicada fue de un estudio
cualitativo llevándose a cabo entrevistas a profesionales exponiendo sus puntos de vista en
donde existen criterios oportunos sobre el derecho de abortar de forma libre sin opresión del
Estado, así como la teoría moral de la ética y la protección al niño no nacido. Desde su
planteamiento jurídico la Constitución protege el derecho a la vida desde su concepción, el
COIP presenta en su artículo 150 las excepciones por las que una mujer puede abortar sin
punibilidad, no obstante, mediante una demanda de inconstitucionalidad, se ha incorporado que
cualquiera que haya sido violada puede practicarlo; la excepción incluía únicamente a mujeres
con discapacidad mental, actualmente se encuentra en estudio un proyecto de ley, quedeberá
ser analizado por la Asamblea.
The research aims to analyze abortion in Ecuador from a bioethical point of view and what is the legal approach. For this, the applied methodology was a qualitative study, conducting interviews with professionals exposing their points of view where there are appropriate criteria on the right to abort freely without state oppression, as well as the moral theory of ethics and protection of the unborn child.
