Resumen
El presente trabajo recaba un recorrido conceptual y analítico sobre la situación que atravesó el Ecuador en el tema laboral y la falta de garantías que por justa causa del covid-19 muchos perdieron sus empleos y otros su sustento de ingresos que como consecuencia se denomina una crisis humanitaria, en donde se evidencio los vacíos legales del código de trabajo y a su vez la falta de aplicación de mecanismos por parte del gobierno y el estado como tal que lo antecede, a efecto de que queremos evidenciar en nuestra investigación y análisis respectivo sobre un recopilatorio de todos los factores negativos y la falta de aplicabilidad y violación de derechos humanos y derechos del trabajador que como consecuencia a esta crisis sanitaria nos dimos cuenta que tenemos una estructura jurídica sin fundamentos claros, ni garantías que sobresean la estabilidad de un trabajador en tiempo de pandemia para poder defenderse ante el empleador.
ABSTRACT This work collects a conceptual and analytical journey on the situation that Ecuador went through in the labor issue and the lack of guarantees that due to the covid-19 many lost their jobs and others their income support, which as a consequence is called a crisis humanitarian law, where the legal gaps in the labor code were evidenced and, at the same time, the lack of application of mechanisms by the government and the state as such that precedes it, to the effect that we want to demonstrate in our investigation and respective analysis on a compilation of all the negative factors and the lack of applicability and violation of human rights and workers' rights that as a consequence of this health crisis we realized that we have a legal structure without clear foundations, or guarantees that supersede the stability of a worker in time of pandemic to be able to defend yourself before the employer.
