Administración de pensiones alimenticias en Ecuador: Regulación jurídica de un fondo de contingencia

Resumen
Esta investigación analiza la necesidad de regular en Ecuador la administración de pensiones alimenticias impuestas a favor de niños, niñas y adolescentes, de manera que los recursos sean usados eficientemente, incluso para cubrir contingencias inesperadas. El objetivo es fundamentar teórica y legalmente la importancia de brindar una respuesta efectiva y oportuna ante situaciones imprevistas que puedan afectar el estado financiero tanto del alimentante como del alimentado, tales como enfermedades del beneficiario que demanden mayores recursos o la situación de desempleo del proveedor de la pensión. El enfoque de la investigación es cuali-cuantitativo, utilizando métodos documentales, descriptivos y explicativos. Se recopila información a través de entrevistas y encuestas, de las cuales se obtuvo perspectivas de profesionales y datos numéricos sobre el nivel de aceptación de la propuesta. Se concluye que la creación de un fondo de contingencia con parte de los recursos provenientes de la pensión alimenticia garantizaría la atención de necesidades imprevistas que no podrían ser solventadas sin dicho capital.
This research analyzes the need to regulate in Ecuador the administration of alimony imposed in favor of children and adolescents, so that the resources are used efficiently, even to cover unexpected contingencies. The objective is to theoretically and legally base the importance of providing an effective and timely response to unforeseen situations that may affect the financial status of both the obligor and the person receiving the payment, such as illnesses of the beneficiary that require more resources or the unemployment situation of the provider of the pension. The research approach is qualitative-quantitative, using documentary, descriptive and explanatory methods. Information is collected through interviews and surveys, from which professional perspectives and numerical data on the level of acceptance of the proposal were obtained. It is concluded that the creation of a contingency fund with part of the resources from the alimony pension would guarantee the care of unforeseen needs that could not be solved without said capital.
