Resumen
Los juicios de impugnación de la paternidad, es un derecho que nos asiste a todos saber nuestro origen y el origen de nuestra prole cuando tengamos dudas sobre este derecho fundamental de la paternidad e identidad que le asiste al padres e hijo respectivamente, el Código de la niñez señala que tenemos derecho a un nombre y apellido por lo general el de nuestros padres bilógicos, pero cuando esta paternidad ha sido adquirida mediante engaño o dolo por parte de la madre, por que sancionar al niño despojándolo del apellido con es reconocido en la sociedad. Este problema social, emocional, jurídico tan frecuente, nos hace recapacitar porque se castiga al niño que ha sido reconocido legal y voluntariamente sancionándolo con la pérdida de su apellido, por los conflictos de sus padres, someterlo a un estado emocional de inestabilidad, falta de confianza ante sus padres, rebeldía, baja autoestima, vulnerándose el principio superior del menor.
