Resumen
De acuerdo al Código Orgánico de la Niñez y Adolescencia (CONA), en vigencia desde Junio de 2009, prescribió la deducción de la tabla de pensiones alimenticias mínimas como un parámetro para que los jueces fijen la manutención. Es desde allí que el Ministerio de Inclusión Económica y Social, por medio del acuerdo ministerial, circula cada año esta tabla con montos mínimos y varios niveles, según el incremento del sueldo básico ecuatoriano. A pesar de ello, los progenitores demandados tienen la potestad de corroborar la paternidad o maternidad, en las audiencias, el número de cargas que tienen aparte del niño, niña o adolescente por el que están siendo enjuiciados. También analizaremos lo que es la prueba de paternidad basada en técnicas científica, del mundo médico que permite establecer la identidad genética (huella única que permite conocer la verdad biológica sin lugar a equívocos), y la relación filial legítima respecto de quien engendró o procreó; adicionalmente temas relacionados con la investigación.
In agreement to the Organic Code of the Childhood and Adolescence (CONA), in force from June, 2009, it prescribed the deduction of the table of food minimal pensions as a parameter in order that the judges fix the subsistence. It is from there that the Department of Economic and Social Incorporation, by means of the ministerial agreement, circulates every year this table with minimal amounts and several levels, according to the increase of the basic Ecuadoran salary. In spite of it, the demanded progenitors have the legal authority to corroborate the paternity or maternity, in the hearings, the number of loads that have apart from the child, girl or teenager for the one that they are being judged. Also we will analyze what is the paternity test based on technologies scientific, of the medical world that allows to establish the genetic identity or procreated; additional topics related to the investigation.
