dc.description.abstractLa aplicación de este derecho está a cargo de órganos que se encargan de administrar justicia, son ellos quienes deben activar la TUTELA JUDICIAL EFECTIVA, cuando un derecho está siendo vulnerado o cuando se puede prever que puede ser violentado. Es responsabilidad del Estado, que dentro de todo proceso se observe este principio; de lo contrario el Estado será responsable por su vulneración y deberá responder de forma obligatoria por su falta de aplicación, quien se vea afectado por tal o cual violación del derecho a la Tutela Judicial Efectiva está en la necesidad de ser indemnizado y de que el daño causado sea reparado.es_ES
