Resumen
A pesar de que existe normativa vigente que protege a los niños, niñas y adolescentes de no ser
revictimizados, su cumplimiento no ha sido efectivo; vulnerando en cada diligencia a las víctimas
y violentando uno de los deberes generales del Estado. Este derecho tan fundamental se inscribe
en garantizar el derecho de las personas a la no revictimización en ningún sentido y, más aún, si
este grupo se encasilla dentro de las personas de atención prioritaria. Esta realidad es frecuente
en los niños y niñas, víctimas de agresiones sexuales, en la que se centró la presente
investigación, por cuanto; el mencionado tipo penal, ha tenido un elevado incremento de
denuncias en estos últimos años. Es por tal motivo que se puede afirmar sin mayor temor que el
sistema procesal ecuatoriano presenta grandes falencias dado que proteger esta garantía se ha
vuelto algo secundario incrementando los perjuicios para las víctimas. La presente investigación
ha demostrado que no se aplica los protocolos para evitar revictimizar a menores en la ciudad
de Guayaquil.
Despite the fact that there are regulations in force that protect children and adolescents from being re-victimized, their compliance has not been effective; violating the victims in each diligence and violating one of the general duties of the State. This fundamental right is part of guaranteeing the right of people not to be re-victimized in any way and, even more so, if this group falls within the category of priority attention. This reality is frequent in boys and girls, victims of sexual aggression, in which the present investigation focused, because; the aforementioned criminal type, has had a high increase in complaints in recent years. It is for this reason that it can be affirmed without much fear that the Ecuadorian procedural system has great shortcomings since protecting this guarantee has become secondary, increasing the damages for the victims. The present investigation has shown that the protocols to avoid re-victimizing minors in the city of Guayaquil are not applied.
