Resumen
El presente trabajo de titulación tuvo por objeto evaluar el Síndrome de Alienación Parental (SAP) y sus efectos sobre la alteración de la tenencia de los tutores sobre los niños que tengan a su resguardo por estar cometiendo un tipo de abuso psicológico que altera la relación parentofilial del menor a sus tutores, lo mencionado se logró por medio de la determinación teórica y legal de la alienación parental y la revisión de contenidos psicológicos de impacto vinculados, en conjunto a las disposiciones legales de protección al derecho a una vida digna, familia e interés superior del niño ISN. Lo mencionado se logró mediante un estudio de base mixta considerando técnicas del paradigma cualitativo, como la revisión bibliográfica y, por otra parte, la elaboración de encuestas a una muestra de 68 estudiantes de derecho que demostró un criterio dual al respecto a la alienación parental, y que fue útil en conjunto a la revisión bibliográfica, doctrinaria y legal para concluir que en efecto, la alienación parental supone un grave daño en la psique del infante, daña la relación parentofilial y atrofia las posibilidades de desarrollo social óptimo en el menor, afectando integralmente el ISN, razón por la que se propuso las bases de un plan estratégico de revisión de casos de alienación, seguimiento, sanción y reparación a los menores afectados.
The purpose of this titling work was to evaluate the Parental Alienation Syndrome (PAS) and its effects on the alteration of the custody of the guardians on the children that they have under their protection for being committing a type of psychological abuse that alters the parent-child relationship. Of the minor to their guardians, the aforementioned was achieved through the theoretical and legal determination of parental alienation and the review of psychological contents of impact linked, together with the legal provisions for the protection of the right to a dignified life, family and interest top child ISN. The aforementioned was achieved through a mixed-based study considering techniques of the qualitative paradigm, such as the bibliographic review and, on the other hand, the preparation of surveys to a sample of 68 law students that demonstrated a dual criterion regarding parental alienation, and that it was useful together with the bibliographical, doctrinal and legal review to conclude that in effect, parental alienation supposes serious damage to the infant's psyche, damages the parent-child relationship and atrophies the possibilities of optimal social development in the minor, affecting the ISN fully, which is why the bases of a strategic plan for the review of cases of alienation, follow-up, sanction and reparation for affected minors were proposed.
