dc.description.abstract | Esta investigación tiene como objetivo determinar la efectividad de la pena en la justicia indígena, con relación a la decisión que tomó la Corte Constitucional del Ecuador en el caso La Cocha. Aplicando metodología descriptiva, deductiva, cuali-cuantitativa, bibliográfica y de campo, con uso de encuestas y entrevistas; concluyendo que; en base al Art. 171 de la Constitución se ejecutó la sentencia N° 113-14-SEP-CC del caso N° 0731-10-EP (La Cocha), la corte Constitucional Ecuatoriana manifestó que sí respetó algunos principios del debido proceso, pero que el acusado fue juzgado por más de una causa, lo que irrespetó los derechos de los acusados. Se observó inexperiencia y desconocimiento del derecho procesal penal, que afectó la imposición de pena en la justicia indígena, donde además de la interculturalidad, costumbres y cosmovisión autóctonos, se debe conocer la norma constitucional, instrumentos internacionales y legislación nacional. dc.description.abstract | The purpose of this investigation is to determine the effectiveness of the sentence in indigenous justice, in relation to the decision taken by the Constitutional Court of Ecuador in the La Cocha case. Applying descriptive, deductive, qualitative-quantitative, bibliographic and field methodology, with the use of surveys and interviews; concluding that; Based on Article 171 of the Constitution, the sentence N ° 113-14-SEP-CC of case No. 0731-10-EP (La Cocha) was executed, the Ecuadorian Constitutional Court stated that it did respect some principles of due process, but that the defendant was tried for more than one cause, which disrespected the rights of the accused.
