Modificación de sanciones con lesiones en violencia contra la mujer o miembros del núcleo familiar según el art. 159 del Código Orgánico Integral Penal

Resumen
La agresión indiferentemente que venga por cualquiera parte del núcleo familiar debe ser intolerable debido que no existe justificación para recurrir a tal tipo de acción sobrepasando el límite permitido.
En toda familia puede existir distintas contradicciones y contrariedades afrontándolas día a día sin importar cuál sea, todos tenemos derecho a tener un pensamiento libre y propio, pero al momento de alguna contradicción o problemática intrafamiliar la violencia no debe ser una solución.
Se busca la subsanación del agresor para poder ser reinsertado ante la sociedad sin que exista su reincidencia.
El planteamiento del Código Orgánico Integral Penal, NO subsana este pensamiento agresivo realizando únicamente la privación de libertad del sujeto.
Puesto que esta propuesta de tesis es que se realice una correcta reparación integral de la víctima y una reparación psicosocial del contraventor porque la problemática se la podría solucionar desde el inicio, por medio del servicio a la comunidad o puesto a orden de alguna institución que maneje ayuda hacia mujeres, niños, niñas, adolescentes, adultos mayores. Dando a este individuo la oportunidad de mejorar y servir a aquellas personas que alguna vez maltrato.
Se incluye en el estudio 200 víctimas de agresión, 29 niños (12%) y 11 niñas (8%). Ciento setenta mujeres (85%) iniciando la respectiva denuncia, solo el 12% continúan hasta el final del procedimiento
The aggression indifferently that comes from any part of the family nucleus must be intolerable because there is no justification to resort to such type of action exceeding the allowed limit. In every family there can be different contradictions and contradictions facing them day to day no matter what it is, we all have the right to have a free and own thought, but at the moment of some intrafamily contradiction or problem violence should not be a solution. It seeks the correction of the aggressor in order to be reinserted before society without its recidivism. The approach of the integral organic penal code does NOT cure this aggressive thinking by only depriving the subject of freedom. Since this thesis proposal is to perform a proper comprehensive reparation of the victim and a psychosocial repair of the offender because the problem could be solved from the beginning, through community service or placed at the disposal of an institution that manages help towards women, children, adolescents, seniors. Giving this individual the opportunity to improve and serve those people who ever mistreat. The study included 200 victims of aggression, 29 children (9%) and 11 girls (6%). One hundred seventy women (85%) initiating the respective complaint, but only 12% continue until the end of the procedure
