Resumen
El desarrollo de esta investigación tiene el objetivo analizar el proceso judicial de
las medidas de protección, contempladas en el Código de la Niñez y Adolescencia,
y la obligación que tiene el Estado a cumplir con la aplicación y ejecución de las
mismas a los niños y adolescentes que se encuentran en situación de
vulnerabilidad, también tomar en cuenta los Convenios Internacionales referentes
al tema y que forman parte de nuestro bloque de constitucionalidad y por lo tanto
de obligatorio cumplimiento. Se enfatiza el contenido de las medidas de protección.
Se analizan las consecuencias de la falta de conocimiento de la normativa y de la
práctica de este tipo de casos por parte de los operadores de justicia, realizando
un análisis del debido proceso, a fin de establecer si existe el respeto a la tutela
judicial efectiva, celeridad, motivación, y correcta aplicación de la normativa
The purpose of this investigation is to analyze the judicial process of the protection measures contemplated in the Childhood and Adolescence Code, and the obligation that the State has to comply with the application and execution of the same to children and adolescents that are in a situation of vulnerability, also take into account the International Agreements on the subject and that are part of our block of constitutionality and therefore of mandatory compliance. The content of the protection measures is emphasized. The consequences of the lack of knowledge of the regulations and of the practice of this type of cases by the justice operators are analyzed, making an analysis of due process, in order to establish whether there is respect for effective judicial protection, speed, motivation, and correct application of the regulations
