Resumen
Este trabajo de investigación tiene como tema “INCIDENTE DE REBAJA DE PENSIÓN ALIMENTICIA FRENTE AL DERECHO A LA IGUALDAD APLICADO AL CASO NO. 09209-2015-03042” en esta investigación demostraremos la vulneración del derecho constitucional de igualdad que sufre el alimentante al momento de requerir la rebaja de la pensión alimenticia frente a la petición de aumento de la misma. Nuestra Constitución, en su artículo 11, numeral 2 manifiesta el derecho de igualdad; pero en el Código de la Niñez y Adolescencia al hablar del derecho de alimentos, podemos notar que existen procedimientos diferentes, vulnerando así el principio Constitucional de igualdad. Por esta razón, vemos necesario reformar el Código de la Niñez y Adolescencia, en su artículo innumerado 8 en el cual se debe aplicar el mismo procedimiento tanto como lo es para el aumento de pensión alimenticia; así también debe ser para la rebaja de la misma.
This research work has the theme “ALIMONY REDUCTION INCIDENT AGAINST THE RIGHT TO EQUALITY AP- PLIED TO CASE NO. 09209-2015-03042” in this investigation, we will show the violation of the constitutional right of equality suffered by the obligor at the time of requiring the reduction of the alimony against the request to increase it. For this reason, we see it necessary to reform the Code of Childhood and Adolescence, in its innumerable article 8 in which the same procedure should be applied as much as it is for the increase of alimony; so it must also be for the reduction of the same.
