Análisis de las vulneraciones cometidas por los funcionarios recaudadores dentro del juicio coactivo BP 1072-I-2016

Resumen
El presente trabajo de investigación tiene por objeto realizar un análisis a las vulneraciones cometidas por los funcionarios recaudadores dentro del Juicio Coactivo BP 1072-i-2016. Estas violaciones se deben al irrespeto del debido proceso y al conjunto de garantías constitucionales necesarias para que las diferentes etapas procesales se desarrollen con justicia y equidad. De acuerdo a la revisión documental del procedimiento se evidenció que dentro de este “Juicio coactivo” ha habido falta de observación a los acuerdos de pago; y, a las solemnidades sustanciales, práctica que obstaculiza el proceso coactivo sin notificar la ORDEN DE COBRO. Además, en la cuantía del título de crédito no se consideraron los pagos efectuados durante el acuerdo; las peticiones formuladas por escrito las despachan a destiempo y luego de varias insistencias; y las resoluciones no están debidamente motivadas; es de destacar que para garantizar el legítimo derecho a la defensa exigen pagos de honorarios onerosos e ilegales. Se concluye que reglamento para el ejercicio de la jurisdicción coactiva por el cual argumentan su procedimiento, va contra de los preceptos constituciones y de derechos humanos universales, sin contar que no es público.
The purpose of this research work is to carry out an in-depth analysis of the violations committed by the Collection Officials within the Coercive Trial BP 1072-I-2016. These violations are due to disrespect for due process and the set of constitutional guarantees necessary for the different procedural stages to be carried out with justice and equity. Within this administrative procedure, misnamed "Coercive Trial" there is disrespect for payment agreements; they go over the substantial solemnities, they block the coercive trial without notifying the COLLECTION ORDER; in the amount of the credit title they did not take into consideration the payments made during the agreement; requests made in writing are dispatched at will and after months of insistence; for seeking their legitimate right to defense, they demand the payment of onerous and illegal fees; within the procedure they do not respect the statutory times for each of the actions; there is no motivation in their resolutions; the Regulations for the Exercise of Coercive Jurisdiction by which they argue their procedure is against the law, not to mention that it is not public.
