Régimen y Naturaleza Jurídica de la zona económica exclusiva del Ecuador: ¿El espacio marítimo sui géneris es de Jurisdicción Nacional?

Resumen
A raíz de la adhesión del Ecuador a la Convención de las Naciones Unidas sobre el Derecho del Mar se establece el ejercicio soberano sobre la Zona Económica Exclusiva, atribuyendo una serie de directrices enfocadas en la implementación de normativa reguladora eficiente y eficaz en la legislación ecuatoriana que permitan sobrellevar un control oportuno sobre los espacios marítimos. No obstante, la reglamentación y regulación vigente ha demostrado no ser factible para la conservación de los recursos del mar, así como la inexistente imposición de sanciones por las antiquísimas disposiciones que poseen los códigos pertinentes, sin ignorar la falta de asignación presupuestaria y la mínima adquisición tecnológica e investigativa que permitan ejecutar las acciones requeridas para uno de los espacios de mayor amplitud que posee el Ecuador.
As a result of Ecuador's adhesion to the United Nations Convention on the Law of the Sea, the sovereign exercise of sovereignty over the Exclusive Economic Zone is established, attributing a series of guidelines focused on the implementation of efficient and effective regulatory norms in Ecuadorian legislation that allow for timely control over maritime spaces. However, the current rules and regulations have proven not to be feasible for the conservation of marine resources, as well as the non-existent imposition of sanctions for the very old provisions that have the relevant codes, without ignoring the lack of budget allocation and minimal technological and investigative acquisition to implement the actions required for one of the largest spaces that Ecuador has.
