Resumen
El presente trabajo tiene como objetivo principal demostrar el efecto jurídico del artículo 464 del Código Orgánico Integral Penal regla 5” ante la negativa, se presumirá que se encuentra en el máximo grado de embriaguez”; el mismo que viola derechos constitucionales, así como Tratados Internacionales, las Garantías y Principios Rectores del Proceso Penal como es la prohibición de autoincriminación, este trabajo demostrará que el prenombrado artículo debería ser susceptible a reforma, puesto que como actualmente se encuentra tipificado viola varias normas de nuestros cuerpos legales y omite el Reglamento a Ley de Transporte Terrestre Transito y Seguridad Vial. Entonces tenemos una disposición legal que viola derechos constitucionales, que va en contra de Tratados Internacionales y del Código Orgánico Integral Penal, además que existe también un reglamento que debe ser aplicado en casos de negativa, se busca que el agente de tránsito deje una constancia de la situación y sea valorada en juicio.
The main objective of this work is to demonstrate the legal effect of article 464 of the Comprehensive Organic Penal Code Rule 5, which states that "in the event of the refusal, it will be presumed that he is in the maximum degree of intoxication"; since it violates constitutional rights, as well as International Treaties, the Guarantees and Guiding Principles of the Criminal Process such as the prohibition of self-incrimination. This thesis will demonstrate that the article in question should be susceptible to reform since as it is currently typified, it violates several norms of our legal bodies and omits the Regulations to the Law of Land Transportation, Traffic and Road Safety. So, we have a legal provision that violates constitutional rights that goes against International Treaties and the Comprehensive Organic Penal Code; also, there is a regulation that must be applied in cases of refusal, it is sought that the transit agent leaves a record of the situation and is valued in court.
